Rockville Centre Resident and Whistleblower Attorney, Theresa A. Vitello Recognized by Super Lawyers' 2013 Edition as a New York Metro Rising Star

Whistleblower attorney Theresa A. Vitello, an associate at Levy Phillips & Konigsberg LLP (“LPK”), has been selected to the Super Lawyers 2013 New York Metro Rising Stars list. Each year, no more than 2.5 percent of the lawyers in the state are selected by the research team at Super Lawyers to receive this honor.

Ms. Vitello joined LPK in 2005 and is a member of the firm’s whistleblower and class actions departments. Ms. Vitello specializes in representing whistleblowers in cases brought on behalf of the Federal and State Governments under the False Claims Act as well as the SEC, IRS, and CFTC whistleblower programs. Among her successes in this area, in U.S. ex rel. Feldman v. the City of New York, 09-CV-8381 (JSR) (S.D.N.Y.), Ms. Vitello represented a physician whistleblower who uncovered Medicaid fraud in New York City’s Personal Care Services program resulting in a $70 million recovery for the United States in December 2011.

Ms. Vitello also specializes in complex litigation and class action matters. She is presently working on the firm’s ERISA and ICA class action cases. Her prior experience includes work on a number of successful multi-district and class action litigation matters, including In re: Pharmaceutical Industry Average Wholesale Price Litigation, Docket No. 01-CV-12257(PBS) (D. Mass.), In Re: IPO Securities Litigation, 21 MC 92 (SAS) (S.D.N.Y.), and In Re: Diet Drugs Products Liability Litigation, MDL No. 1203 (E.D.Pa.). Other representative matters Ms. Vitello has worked on include a New York City breach of fiduciary duty case which resulted in a $7 million verdict (Bamira v. Parker Chapin Flattau & Klimpl, LLP et al., Index No. 06/604256 (N.Y.C. Civ. Ct.)) and an appeal which resulted in an additional $2.5 million for an injured Ulster County construction worker (Doviak v. Lowe’s Home Centers et al., 880 N.Y.S.2d 1348 (N.Y. 3d Dept. 2009)).

Ms. Vitello is a member of several bar associations, including the Nassau County Bar Association, where she is a frequent lecturer on the False Claims Act and health care fraud. She is licensed to practice law in the States of New York, New Jersey, and Pennsylvania as well as a number of federal courts. She is a 2002 graduate of Villanova Law School and earned her B.A. magna cum laude from Fairfield University in 1999, where she was also selected a member of Phi Beta Kappa.
